PROMOTION OF ACCESS TO INFORMATION ACT(No. 2 of 2000)SECTION 14 MANUAL
1. INTRODUCTIONTCTA was established in 1986 to give effect to the Treaty on the Lesotho Highlands Water Project between the Government of South African and the Government of Lesotho. In 2000, the Government of South Africa reviewed the function and purpose of TCTA in line with changing national priorities and vested additional functions with TCTA to further support the wider water services sector. TCTA operates within the regulatory framework of the National Water Act, 1998 (Act 36 of 1998) and is a Schedule 2 Public Entity in terms of the provisions of the Public Finance Management Act, 1999 (Act 1 of 1999). This is the first edition of TCTA's manual in terms of the Act. It will be revised to accommodate, as far as possible, the requirements of the public as determined from time to time based on requests received. TCTA supports the objective Act to strike a balance between the rights to information against other rights, such as that of privacy, while maintaining efficient governance as a public entity. The purpose of this manual is to provide information to those who wish to request records in terms of the Promotion of Access to Information Act, 2000 (Act 2 of 2000). If you have any problems or difficulties in using this manual, please do not hesitate to contact the relevant Deputy Information Officer for assistance. 2. GUIDE IN TERMS OF SECTION 10 OF THE ACT(Section 14(1)(c) of the Act)The South African Human Rights Commission ("SAHRC") will be compiling a comprehensive guide, in each official language, to assist a person to exercise any right contemplated in this Act. PARTICULARS OF INFORMATION OFFICER AND DEPUTY INFORMATION OFFICERA request for access to records held by TCTA must be made by completing the prescribed form and by delivering, posting or transmitting it to any of the addresses referred to in paragraph 2 above. Please note that the prescribed access fee and request fee may be charged. Copies of the request form as well as details of this fee can be obtained from the website of the SAHRC or that of the Department of Constitutional Development (http://www.doj.co.za). Copies of the following documents may be accessed from TCTA at no charge if collected in person or downloaded from the website. A nominal charge relating to postage and packaging may be required if information has to be posted. a) TCTA Annual Reports b) TCTA Corporate Plans c) TCTA EE Plan and Reports d) Project Information relating to the Lesotho Highlands Water, Berg Water Project and Vaal River East Sub-System Augmentation Project. e) Copies of the Notice of Establishment and Ministerial Directives f) Copies of the TCTA Workplace Skills Plans. DISCLOSURE IN TERMS OF SECTION 15No records are available in terms of section 15 of the Act. Access to records will be granted in the format requested or in the format that the records exist, if the requested format is not available. 6. 6.2 Other informationInformation relating to the management and daily business of TCTA such as the records relating to employees and ex-employees, including policies and procedures, details of employment and remuneration and employee files, standard employment contracts, personnel reports, human resources manual, financial and administrative records, insurance policies shall only be made available to the requestor subject to the provisions of the Act. 7. INFORMATION HELD IN TERMS OF OTHER LEGISLATIONThe following are some of the statutes in terms of which records are held by TCTA. This is not an exhaustive list and it must be pointed out that these records are not necessarily available to requestors in terms of the Act-

AVAILABILITY OF THE MANUALFurther copies of this manual, as updated, can be obtained and inspected at the offices of TCTA at the address listed in paragraph 2 above.
